Terms and Conditions

1. Definitions
- DIPAFI LIGHTING SRL, with headquarters in Bucharest County, Calea Dorobantilor 234, J40/19359/2017, CUI 38506081, share capital - 200 ron, organized under Romanian law.

CONTENT has the following definition:
– all the information on the SITE that can be visited, viewed or otherwise accessed by using a digital device;
– the content of any e-mail sent to its USERS or CUSTOMERS by artledistic.com by electronic means and/or any other means of communication available;
- any information communicated by any means by an employee or collaborator of artledistic.com to the USER or CLIENT, according to the contact information, specified or not by him;
- information related to the products, services and/or rates applied by artledistic.com in a certain period;
- information related to the products, services and/or rates practiced by a third party with whom artledistic.com has concluded partnership contracts, during a certain period;
– data related to artledistic.com, or other privileged data of it.

SERVICE – the e-commerce service conducted exclusively on the publicly available portions of the SITE, in the sense of giving the CLIENT the possibility to contract products and/or services using exclusively electronic means, including other means of remote communication.
MEMBER – The natural person who has or obtains access to the CONTENT, through any means of communication (electronic, telephone, etc.) or based on a user agreement between artledistic.com and it and who requires the creation and use of an ACCOUNT.
ACCOUNT – the set consisting of an e-mail address and a password that allow a single MEMBER access to restricted areas of the SITE through which access to the SERVICE is made.
CLIENT – The person who has or obtains access to the CONTENT and SERVICE, after the creation of the MEMBER ACCOUNT.
ORDER – an electronic document that acts as a form of communication between the Seller and the Buyer through which the Buyer conveys to the Seller, through the Site, his intention to purchase Goods and Services from the Site.
Price marked in gray - the price you can see on the page of each product, along with the sale price offered/practiced by artledistic.com, is the sale price without discount. We display this price to be used in the comparative evaluation of product costs, so you will find it next to each product, above or after the selling price charged by artledistic.com.
DOCUMENT – these Terms and Conditions
DISTANCE CONTRACT - according to the definition contained in GEO 34 of June 4, 2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts art. 2 point 7, as it transposed Directive 2011/83/EU on consumer rights: any contract concluded between a professional and a consumer within an organized distance sales or service provision system, without the simultaneous physical presence of the professional and the consumer , with the exclusive use of one or more means of remote communication, up to and including when the contract is concluded;
NEWSLETTER / ALERT – means of periodic information, exclusively electronic, on the products, services and/or promotions carried out by artledistic.com in a certain period, without any commitment on the part of artledistic.com with reference to the information contained therein.
TRANSACTION – collection or reimbursement of an amount resulting from the sale of a product / service by artledistic.com to the Customer, by using the services of the card processor agreed by artledistic.com or by bank transfer, regardless of the method of delivery.

2. General
2.1. The document establishes the terms and conditions of use of the Site/Content/Service by the Member or Client, in case he does not have another valid user agreement concluded between artledistic.com and it.
2.2. The use, including but not limited to accessing, visiting and viewing the Content/Service, implies the Member's or Client's adherence to these terms and conditions; The customer undertakes to permanently monitor the terms and conditions that can be updated, modified and completed. In case of misunderstandings, the Terms and Conditions valid at the time of the order and its written notification to artledistic.com shall apply.
2.3. Access to the Service is made exclusively by accessing the publicly available artledistic.com website.
2.4. By using the Site/Content/Service, the Member or Customer is solely responsible for all activities arising from its use. Also, he is responsible for any material, intellectual or electronic damages or any other kind caused to the Site, the Content, the artledistic.com Service or any third party with whom artledistic.com has concluded contracts, in accordance with the Romanian legislation in force.
2.5. If the User or the Client does not agree and/or does not accept and/or revokes the consent given for the Document, send an e-mail to contact@artledistic.com specifying that:
2.5.1. He renounces: access to the Service, other services offered by artledistic.com through the Site, receiving newsletters/alerts and/or communications from artledistic.com of any kind (electronic, telephone, etc.)
2.5.2. It can revert at any time on its decision not to agree and/or not accept the document, in the form in which it will be available at that time.
2.6. To exercise the right provided for in art 2.5, he can contact artledistic.com or use the links in the content received from artledistic.com intended for this purpose.
2.7. In the event that the Client has paid the value of all unpaid Contracts to artledistic.com and revokes his consent expressed in favor of the Document during the execution of an Order, artledistic.com will cancel his Order without any subsequent obligation of any party to the other or without either party can claim damages from the other party.
2.8. This Site is addressed only to Members who are natural persons who are at least 18 years old, who have completed the appropriate registration steps and who have not been suspended or removed by artledistic.com, regardless of the reason for the suspension or removal. The possibility to order online is only available to people with a delivery address in Romania. By becoming a Member, the person declares that he meets the aforementioned conditions.

3. Content
3.1. The content, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Site, is the exclusive property of artledistic.com, its all rights obtained in this regard directly or indirectly (through licenses for use and/or publication) being reserved.
3.2. The Member or Customer is not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any content in any context other than that originally intended by artledistic.com, include any content outside the artledistic.com site, removing the signs that signify artledistic.com's copyright on the content, as well as participating in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the content, except with the express consent of artledistic. com.
3.3. Any content to which the Member or the Client has and/or obtains access by any means, is subject to the Document, if the content is not accompanied by a specific and valid user agreement concluded between artledistic.com and it, and without any an implicit or express warranty made by artledistic.com with reference to that content.
3.4. The Member or Client may copy, transfer and/or use content only for personal or non-commercial purposes, only if they do not conflict with the provisions of this Document.
3.5. If artledistic.com gives the Member or the Client the right to use, in the form described in a separate user agreement, certain content, to which the Member has or obtains access following this agreement, this right extends only to that or those contents defined in the agreement, only for the period of its existence or these contents on the site or the period defined in the agreement, according to the defined conditions, if they exist and do not represent a contractual commitment on the part of artledistic.com for the respective Member, Client or any other third party who has/obtains access to this transferred content, by any means and who could be or is harmed in any way by this content, during or after the expiration of the user agreement.
3.6. No content transmitted to the Member or Client, by any means of communication (electronic, telephone, etc.) or acquired by him by accessing, visiting and/or viewing does not constitute a contractual obligation on the part of artledistic.com and/or the employee or collaborator of artledistic .com that mediated the transfer of content, if it exists, in relation to that content.
3.7. Any use of the Content for purposes other than those expressly permitted by the document or the user agreement that accompanies it, if it exists, is prohibited.

4. Contact for Customers and Members
4.1. artledistic.com publishes on the website the complete and correct identification and contact data for the Customer or Member.
4.2. By using the contact form or the service present on the website, the Member or Client automatically allows artledistic.com to contact him by any available means, including electronic means.
4.3. Partially or fully filling out the contact form and sending it does not in any way represent a commitment on the part of artledistic.com to contact the Member or the Client.
4.4. Accessing the Site, using the information presented within it, visiting the pages or sending e-mails or notifications addressed to artledistic.com is done electronically, by telephone, or any other means of communication available to the Member or Client and artledistic.com , thus considering that he consents to receiving notifications from artledistic.com electronically and/or by telephone, including communications by e-mail or by announcements on the website.

5. Newsletters and alerts
5.1. When the Member or Client creates an Account on the Site, accepting the Document (Terms and Conditions), he has the right to express his consent or not to receive newsletters and/or alerts from artledistic.com.
5.2. The data collected from the Member for the purpose of sending newsletters and/or alerts can and will be used by artledistic.com within the limits of the Privacy Policy.
5.3. Opting out of receiving newsletters and/or alerts by the Member or Client can be done at any time:
5.3.1. Using the specially intended link within any newsletters and/or alerts received (at the bottom of the email in the "Click here to unsubscribe" section
5.3.2. By modifying his acceptance to receive newsletters and/or alerts and using pages from restricted areas, within the Member's individual Account, on artledistic.com.
5.3.3. By contacting artledistic.com on the dates above, in accordance with the contact information, and without any subsequent obligation of any party to the other or without any party being able to claim damages to the other.
5.4. Renunciation of receiving newsletters and/or alerts does not imply renunciation of the consent given for the document and applies only after the transmission of the intention to renounce.
5.5. artledistic.com reserves the right to select the people to whom it will send newsletters and/or alerts, as well as the right to remove from its database any Member or Client who previously expressed their consent to receive newsletters and/or alerts, without any subsequent commitment on the part of artledistic.com, or any prior notification thereof.
5.6. artledistic.com will not include in the newsletters and/or alerts sent to the Member or the Client, any other kind of advertising material in the form of content that refers to any third party that is not a commercial partner of artledistic.com, at the time of sending the newsletters- them and/or alerts.

6. Privacy policy
6.1. artledistic.com can collect personal data and data of a special nature, on the pages of its Sites, only with the voluntary consent of the Member or the Client, for the following purposes:
- validation, dispatch and invoicing of orders to him (artledistic.com requires written or telephone confirmation to send the first order for a new Account, for data compliance);
- after the validation of the order, for the transmission of information regarding the products, delivery periods, cancellations or problems of any nature related to an order or a contract, to the services or products purchased by him;
- to facilitate his access to the service;
- sending periodic newsletters and/or alerts, exclusively in electronic format;
- statistical purposes.
By creating the Account, each Member or Client has expressed their consent for artledistic.com to collect and administer their personal data, under the conditions and in compliance with the provisions of Law 677/2001. Any Member or Client has the right to obtain from artledistic.com, through a written, signed and dated request, free of charge:
a) confirmation of the fact that the data concerning him are or are not processed at a given moment;
b) as the case may be, rectifying, updating, blocking or deleting data whose processing is not in accordance with the law, especially incomplete or inaccurate data;
c) as the case may be, the transformation into anonymous data of data whose processing is not in accordance with the law;
d) notification to third parties to whom the data of any operation carried out according to letter b) or c), if this notification does not prove impossible or does not involve an effort disproportionate to the legitimate interest that could be harmed.
Any Member or Client has the right to object at any time, for well-founded and legitimate reasons related to his particular situation, by sending to artledistic.com a written request, dated and signed, that the data concerning him make the object of processing, except in cases where there are legal
provisionsto the contrary. In case of justified opposition, the processing can no longer concern the data in question.
Any Member or Client has the right to object at any time, free of charge and without any justification, by sending to artledistic.com a written request, dated and signed, that the data concerning it be processed for the purpose of direct marketing, on behalf of the operator or a third party, or to be disclosed to third parties for such a purpose.

6.2. artledistic.com may involuntarily collect other data (IP address, time of visit, place from which access is made, name and version of internet browser, operating system, including other parameters) provided by the internet browser through which access is made to site and can be used by artledistic.com to improve the services offered to its Customers or Users, or for statistical purposes; the exception is the case where the provisions of the document are violated, in the event that the result of the Member's/Client's actions goes against the interests or causes damage of any kind on the part of artledistic.com and/or any third parties with whom artledistic.com has partnership contracts in that moment.
Cookies policy on artledistic.com
A cookie is a small file, a special text, often coded, sent by a server to a web browser and then sent back (unmodified) by the browser, every time it accesses that server. The cookie is installed through the request issued by a web server to a browser (eg: Internet Explorer, Chrome, Mozilla) and is completely "passive" (it does not contain software programs, viruses or spyware and cannot access the information on the hard drive the user). Cookies are used for authentication as well as for tracking user behavior; typical applications are the retention of user preferences and the implementation of the "shopping basket" system. These files make it possible to recognize the user's terminal and present the content in a relevant way, adapted to the user's preferences. Cookies provide users with a pleasant browsing experience and support artledistic.com's efforts to provide comfortable services to users: eg: - online privacy preferences and shopping cart history. They are also used in the preparation of anonymous aggregated statistics that help to understand the way in which a user benefits from artledistic.com, allowing the improvement of the structure and content but excluding the personal identification of the user.
artledistic.com uses two types of Cookies: per session and fixed (temporary files that remain in the user's terminal until the end of the session or the closing of the application/web browser). The fixed files remain on the user's terminal for a period in the Cookie parameters or until they are manually deleted by the user. The cookies used by the partners of the operator of a web page, including without limitation the users of the web page, are the subject of the respective Privacy Policy.
A visit to artledistic.com may place: Website performance cookies, visitor analysis cookies, geotargetting cookies, registration cookies, advertising cookies.
The personal data collected through the use of Cookies can only be collected to facilitate certain functionalities for the user and are encrypted in a way that makes it impossible for unauthorized persons to access them. In general, an application used to access web pages allows cookies to be saved on the terminal by default.

These settings can be changed so that the automatic administration of Cookies is blocked by the web browser or the user is informed every time cookies are sent to his terminal. Detailed information about the possibilities and ways of managing Cookies can be found in the settings area of the application (web browser). Limiting the use of Cookies may affect certain functionalities of artledistic.com. Cookies represent the central point of the efficient functioning of the Internet, helping to generate a friendly browsing experience adapted to the preferences and interests of each user. Refusing or disabling cookies may make some sites unusable. Due to their flexibility and the fact that most of the most visited and largest sites use cookies, they are almost unavoidable; disabling cookies will not allow the user access to the most widespread and used sites, including Youtube, Gmail, Yahoo and others.
Examples of important uses of cookies:
- Content and services adapted to the user's preferences - categories of products and services.
- Access tailored to user interests – password retention.
- Retention of child protection filters regarding Internet content (family mode options, safe search functions).
- Measurement, optimization and analytics features – such as confirming a certain level of traffic on a website, what type of content is viewed and how a user arrives at a website (eg through search engines, directly, from other websites- uri etc). The websites carry out these analyzes of their use in order to improve the sites for the benefit of the users.
Security and privacy issues Cookies are NOT viruses and use plain text formats; they are not made up of pieces of code so they cannot be executed or auto-run. Consequently, they cannot be duplicated or replicated on other networks to run or replicate again. Since they cannot perform these functions, they cannot be considered viruses. Since cookies can be used for negative purposes because they store information about the preferences and browsing history of users, both on a specific site and on several other sites, being used as a form of Spyware (spying on consumer activity), many anti-spyware products constantly mark cookies for deletion during anti-virus/anti-spyware deletion/scanning procedures.
In general, browsers have integrated privacy settings that provide different levels of cookie acceptance, validity period and automatic deletion after the user has visited a certain site. Since identity protection is very valuable and represents the right of every internet user, it is advisable to know what possible problems cookies can create. Because through them, information is constantly transmitted in both directions between the browser and the website, if an attacker or unauthorized person intervenes during data transmission, the information contained in the cookie can be intercepted. Although very rare, this can happen if the browser connects to the server using an unencrypted network (ex: an unsecured WiFi network). Other cookie-based attacks involve missetting cookies on servers. It is very important for the User to choose the most suitable method of personal information protection and to:
- Customize your browser settings regarding cookies to reflect a comfortable level of cookie security for you.
- Set long expiration periods for storing browsing history and personal access data.
- Consider setting your browser to delete individual browsing data each time you close your browser. This is an option to access the sites that place cookies and to delete any visit information when closing the browsing session.
- Install and constantly update antispyware applications.
Many of the spyware detection and prevention applications include detection of attacks on websites. Thus, it prevents the browser from accessing websites that could exploit the vulnerabilities of the browser or download dangerous software. It is recommended to update the browser programs constantly, because many of the attacks based on cookies are carried out by exploiting the weak points of the old versions of the browsers. All modern browsers offer the possibility to change cookie settings. These settings are usually found in "options" or in the "preferences" menu of the browser.
6.3. The customer has the right to object to the collection of his personal data and to request their deletion, thus revoking his consent given for the document, and thus waiving any implicit right specified therein and without any subsequent obligation of either party to the other or without any party can claim damages to the other, but only in accordance with art. 2.8.
6.4. To exercise the rights according to art. 6.3, the Customer or Member will contact artledistic.com, according to the contact details available on the website, valid at that time.
6.5. Using the forms available on the website, the Customer or Member has the right to modify the data that he initially declared to reflect any change that has occurred, if any.
6.6. If the Client opts for online card payment of the value of the orders, contract and/or contracts, the authorization and remittance for settlement of the card acceptance transactions is carried out exclusively through the commercial company PayU S.A. through the integrated solution; PayU S.A. is the supplier of artledistic.com software solution to facilitate electronic commerce, i.e. payment services, payment administration and anti-fraud protection.
All types of cards issued by Romanian and foreign banks under the VISA and MasterCard logos are accepted, provided that the issuing banks have activated them for online payment. Also, credit card payments are accepted for installment payments as listed on the payment information page. Other payment methods are bank transfer or cash on delivery.
6.7. artledistic.com does not request or store any information related to the Customer's bank card or cards, these being processed directly on the servers of the online payment service provider.
6.8. The privacy policy of artledistic.com refers only to the data provided voluntarily by the Client or Member exclusively on the site. artledistic.com is not responsible for the privacy policy practiced by any other third party that can be reached through links, regardless of their nature, outside the site.
6.9. artledistic.com undertakes that the collected data of the Client/Member is used only in accordance with the stated purposes and not to publish, sell, rent, license, transfer, etc. the database containing information related to the personal or special data of the Member/Client of any third party not involved in the fulfillment of the declared purposes.
6.10. Exception from the provisions of art. 6.9 will make the situation in which the transfer/access/viewing/etc is required by the competent bodies in the cases provided by the regulations in force on the date of the occurrence of the event.
6.11. The bank card processor approved by artledistic.com, Netopia SRL. has the right to access/view any type of data/documents, generated following an order issued, canceled orders, contract, canceled contract or an honored contract, in order to investigate any Transaction, if it exists.
6.12. artledistic.com guarantees that the personal data of a User, collected through the contact form, will be used only until the problem communicated by him is resolved, after which they will become exclusively statistical data.
6.13. artledistic.com is not responsible for failures that may endanger the security of the server on which the database containing this data is hosted.

7. Online sales policy
7.1. Access to the service
7.1.1. Access to the service is allowed to any Member who has or creates an Account on the site
7.1.2. To be allowed access to the service, the Member will have to accept the provisions of the Document.
7.1.3. artledistic.com reserves the right to limit the customer's access to the Service and marketing campaigns (not to include him in the promotion and loyalty campaign, to allow him to order only with advance payment, etc.) as well as the right to cancel orders already placed if it considers that based on the behavior of the Customer (placing and refusing more than two orders in the payment on delivery system, placing orders that are later canceled or modified except for the cases allowed by art. 7.3 .7, the use of biased language, infringement of intellectual property rights, etc.), the access and existence of the Client's Account could harm artledistic.com in any way. This right can be exercised at any time and it is not necessary to notify the Client in this regard.
7.1.4. Each Member can have only one Account. It is forbidden to share an Account between several Members/Clients.
7.1.5. In the event that accesses shared by several Customers are discovered, artledistic.com reserves the right to cancel or suspend the Customer's access to the Content or Service. If there are orders placed from suspended or canceled accounts, they will be canceled automatically.
7.1.6. artledistic.com can refuse an order following a prior notification addressed to the Client, without any obligations between the parties and without a party being able to claim damages, for the following situations:
- failure / invalidation of the online transaction;
- non-acceptance by the issuing bank of the Client's card / the transaction;
- provision of incomplete or incorrect data by the Client;
- the Client's activity may cause damage to the artledistic.com website, the company Dipafi Business Srl and/or its partners;
- The customer uses the Service in a way that does not conform to normal usage and good faith or exercises his rights in order to harm or damage artledistic.com or in an excessive and unreasonable way, contrary to good faith;
- consecutive failed deliveries due to the Customer's fault;
- other justified reasons (e.g.: unjustified placement and cancellation of more than three orders in a 30-day period).

7.2. Products and services
7.2.1. artledistic.com can publish on the website information about products, services and/or promotions practiced by it or by any other third party with whom artledistic.com has concluded contracts or partnership agreements, during a certain period and within the limit of available stock.
7.2.2. The products and/or services purchased through the service are intended exclusively for the personal use of the Client.
7.2.3. artledistic.com may limit the ability to purchase some products or services available on the site at a given time, to one or more Customers, for valid reasons.
7.2.4. All prices related to the products or services presented on the site are expressed in RON (RON) and are final.
7.2.5. The RRP price means the price recommended by the manufacturer for sale in stores, shopping centers or any other commercial spaces where discounts are not applied. These tariffs are purely informative and have no legal value, not being assimilated and not included in the reduced price sales, as defined by OG 99/2000 regarding the sale of market products and services.
7.2.6. The invoicing of the purchased products is done exclusively in RON using the information provided by the Customer in the intended form. artledistic.com is not responsible for the correctness of the information provided by the Customer for the invoice. Invoices are issued as follows: for payments made prior to receiving the products and services, an advance invoice is issued, and for payments made at the time of receiving the products, a final invoice is issued. Cancellation invoices are issued for corrections (cancellations, returns). All invoices are issued and registered automatically and included in fiscal reports. Corrections and changes to the issued invoices are not accepted except within the specified limits.
7.2.7. Payment for products and/or services purchased through the service can be made both online with a debit card, by bank transfer and upon delivery to the courier only in cash.
7.2.8. In the case of online card payments, artledistic.com is not/cannot be held responsible for any other additional costs borne by the customer, including but not limited to currency conversion fees applied by the bank issuing the card, if the currency of its issuance differs from RON. The responsibility for this action is borne by the client alone.
7.2.9. Cash payment on delivery (to the courier) is a payment method available for all products. Payment in cash on delivery (to the courier) is additionally charged with 4 lei/order.
7.2.10. The information from the sales events used to describe the products, characteristics and weight available on the site (static / dynamic images / multimedia presentations / links to other sites, etc.) do not represent a contractual obligation on the part of artledistic.com, they are for the purpose of presentation . artledistic.com can withdraw a product offer or modify it at any time until the order is placed, without owing damages or other penalties to any potential customer.
7.2.11. In the images of the products and/or services, artledistic.com reserves the right to use other products (accessories / etc.) that may not be included in the costs of the respective products and implicitly will not be delivered when purchasing the products. In this case, it is expressly stated in the product description which good is for sale and is also marked in the image.
7.2.12. In the unlikely event that artledistic.com will not be able to honor part of the products, it will notify the Customer by email, offering one of the alternatives:
a. canceling the order or removing from the order the product that can no longer be delivered
b. receiving a voucher on the website for purchases made only on artledistic.com
7.3. Online order
7.3.1. The customer can place orders for products sold at a given time, exclusively on the website, the offers being limited in time (after the indicated period no more orders can be placed and the articles are no longer visible on artledistic.com). The price displayed on the website at the time of the order will not change, being firm. No more orders can be placed for an offer that has expired.
7.3.2. By completing the order, the Customer agrees that all the data provided by him, necessary for the purchase process, are correct, complete and true on the date of placing the order, named in this document and the order issued.
7.3.3. The distance contract is considered concluded by artledistic.com when the order placed by the Customer is confirmed electronically by artledistic.com, following the receipt of all products (quantitative and qualitative) from that order by artledistic.com (directly or through subcontractors).

Moreover, before validating the Customer's order and before shipping the products, artledistic.com has the right to contact the Customer, by any means available / agreed by artledistic.com (telephone or e-mail), to obtain personal confirmation by Customer of his identification and delivery data. Customers accept that artledistic.com cannot be forced to validate/deliver products to people who have not confirmed the delivery and identification data.
7.3.4. artledistic.com will unilaterally denounce and automatically cancel the order made by the Client, even without prior notification addressed to the Client, without any subsequent obligation of any party to the other or without any party being able to claim damages from the other in the following cases:
7.3.4.1. non-acceptance by the issuing bank of the Client's card, of the transaction, in the case of online payments;
7.3.4.2. invalidation of the transaction by the card processor approved by artledistic.com, in the case of online payment;
7.3.4.3. the data provided by the Customer regarding the delivery (address, contact details) on the website are incomplete or incorrect;
7.3.4.4. the Client's activity on the site may and/or cause damages of any kind on the part of artledistic.com and/or its partners;
7.3.4.5. making more than two consecutive failed deliveries;
7.3.4.6. for other objective reasons.
7.3.5. If the Customer cancels an order with payment made in advance, by confirmed bank transfer or by the online card payment solution and in which the bank issuing the Customer's card has authorized the bank transaction, this amount will be reimbursed by artledistic.com in a maximum of 14 days from the date on which artledistic.com became aware of this fact or it can be converted into artledistic.com credits under the conditions of art. 7.9.5 at the Customer's request.
7.3.6. In the event that some products ordered by the Customer through an order made with payment made in advance (by confirmed bank transfer or by the online card payment solution) are no longer available in stock for reasons independent of artledistic.com, artledistic. com will inform the client of this fact as soon as it becomes aware of the unavailability and will order the reimbursement of the amounts paid in advance within a maximum of 14 days from the notification to the client. In this situation, artledistic.com reserves the right to offer, in addition to the due amounts repayable in advance, promotional credits (free) for any product that was ordered and became, after the order confirmation and for reasons independent of artledistic. com, unavailable for delivery. The use of credits can only be done on artledistic.com and is conditioned by the customer's standard behavior; 1 credit is equivalent to 1 RON and cannot be transferred between accounts or users. Any suspicion of fraud in the Customer's behavior leads to the invalidation of the free promotional credits.
7.3.7. A placed order can be changed only in the following situations and only at the Customer's request. The customer will request this in writing, sending an e-mail to contact@artledistic.com clearly mentioning the request and the order number.
a. The customer renounces a product and notifies artledistic.com before shipping the order
b. Increasing the quantity of a product that already exists in an order, a product that is in an active campaign at the time of the order supplement request
c. Delivery delay by a maximum of two weeks beyond the maximum delivery limit
d. Changing the delivery address
e. Cumulation of orders (valid only for orders with payment on delivery) with close delivery periods (maximum one day difference from the last day of the interval). In the case of cumulating an order, the initial order is canceled and its status will appear as "order cancelled", and the products related to the cumulated order will be added to the order with which the cumulation is requested.
f. Modification of the payment method
g. Modification of data for invoicing. For invoices already issued, changes cannot be made regarding the legal/natural person (replacement with a new person), only corrections (of the name/name, contact details, etc.).
7.3.8. Orders cannot be modified, if the Customer opts for online payment or by bank transfer of their value.
7.3.9. If a Customer modifies his personal data, using the forms available on the website, all orders in progress existing at that time, keep the data defined/accepted by the Customer before the moment of modification, being taken into account for delivery and contact, the new data modified accordingly.
7.4. Telephone order
7.4.1. The Customer / Member cannot make telephone orders. The Customer / Member cannot request to change the order over the phone.
7.5. Contract and completion
7.5.1. artledistic.com will issue and transmit to the Customer all the necessary documents certifying the purchase of the products/services by the Customer in accordance with the legislation in force.
7.5.2. artledistic.com will facilitate informing the Customer about the completion stage of his order by sending an information e-mail to the address indicated by him. The issued invoice will include all mandatory mentions in accordance with art. 319 of Law no. 227/2015 regarding the Fiscal Code and can be downloaded in pdf format from the Member's account.
7.5.3. The contract to which are added the documents certifying the delivery of the parcel to the Customer by the courier (AWB signed and settled) from artledistic.com, becomes an honored Contract.
7.5.4. The contract is concluded for a specified period. It will be considered terminated when the parties have fulfilled their mutual obligations within the terms and conditions established by this Document.
7.5.5 If there are differences between the list of delivered products (printed on the back of the AWB) and the contents of the package, the Customer has the obligation to notify artledistic.com and the courier (if the finding was made in his presence) within a maximum of 24 hours from at the reception of the parcel by phone or by e-mail to the address contact@artledistic.com with the related details (photo, explanations, etc.). If the Customer did not make the determination in the presence of the courier, he CANNOT invoke the differences.
7.6. Transport
7.6.1. The delivery to the Customer of the products purchased from artledistic.com is carried out only through the fast courier system.
The price of product delivery applied by artledistic.com is 19.9 RON regardless of the weight of the package. The customer can check the number of shipments of an order and their status in the My Account section on artledistic.com. artledistic.com does not guarantee in any way that an order is sent in a single shipment, nor does it request additional fees for delivery in two shipments. The method of packaging and delivery is at the free choice of artledistic.com, respecting the obligation of full delivery of the products within the assumed period.
For bulky parcels, artledistic.com does not add a handling fee.
Under certain conditions, artledistic.com can offer free shipping (depending on the value of the order or other promotional activities). artledistic.com cannot be obliged in any way to offer free shipping if the Customer does not comply with the standard conditions of use of artledistic.com services.

7.6.2. The delivery time of an order is expressly communicated when placing it and is a range of days influenced by: processing times in the artledistic.com warehouse, working days of the month, the number of products in the order and the processing times of each product, etc. As a rule, products from an order are delivered in a single package with a unique AWB (partial products from an order are not delivered).
Deliveries will usually be made within the period assumed when placing the order (varies between 1 day and 4 days) and the Customer can obtain information on the delivery status at any time. If the product can be delivered beyond the above-mentioned deadline, artledistic.com will immediately inform the Customer by email offering two options: The Customer can either cancel (in writing) the order/product or accept the new proposed delivery deadline. In the event that the payment was made in advance prior to delivery, the amounts paid will be reimbursed in full according to the law, within a maximum of 14 days from the date of cancellation.
7.6.3 The customer can receive, as a promotional offer, free delivery for the purchase of goods with a total value over 249 RON, only under certain conditions, including but not limited to:
a. package weight under 10 kg
b. maintaining the order in the initial form (without changes/postponements)
c. in case of return, the Customer converts the amounts into vouchers
The offers are communicated and accepted at the time of placing the order. Freebies are not mandatory for artledistic.com. Offering free shipping does not preclude charging a handling fee for bulky packages.
7.7. Quality and guarantees
7.7.1. artledistic.com respects the guarantee provisions according to the Romanian legislation in force. Clear details related to these guarantees are given by the product sheets and no member can request an extended guarantee, more than the one mentioned. The guarantee applies to normal conditions of use and is valid only for products purchased and paid for by the Customer from artledistic.com. The products benefit from a guarantee of conformity according to the provisions of Law 449/2003, as it transposed Directive 1999/44/EC on the sale of consumer goods and related guarantees, or if an extended guarantee period is specified in the product presentation, the longer term applies long. The responsibility of artledistic.com, according to the provisions of art. 9-14 of Law 449/2003, is committed if the lack of conformity appears within a period of 2 years, calculated from the delivery of the product. The guarantee involves reimbursement of the value for non-compliant products for which the Customer notifies the merchant in writing within the legal term; artledistic.com does not replace or repair defective or non-compliant products. Non-compliant products become the property of artledistic.com. The customer is not entitled to compensation or penalties for non-compliant products and by placing the order declares that he accepts to receive the counter value of the products and transport in case of non-compliance.
7.7.2. Clear details about the characteristic features of each product are provided both on the website and in writing in the document-list printed on the back of the AWB. The customer is obliged to keep this document-list and to respect the indications on it. Information regarding the terms and conditions of the artledistic.com guarantee and the general usage instructions of the various types of products can be handed over to the Customer as a document available at the artledistic.com address, by e-mail, or in the form of a brochure inserted in each parcel (case by case). If this information has not reached the Client, he can obtain it at any time by telephone request or e-mail to contact@artledistic.com
7.8. Renunciation of the contract and return of the products
7.8.1. With the exception of the limitations of art. 7.9 regarding the purchase with artledistic.com credits, the artledistic.com Customer can return the products purchased through a Contract and is entitled to receive the full consideration paid for the products, in the following situations:
7.8.1.1. The products have severe damage that makes them non-compliant;
7.8.1.2. The delivered products are different (specifications, quantity, etc.) compared to the order placed;
7.8.1.3. The products have manufacturing defects
7.8.1.4 The customer withdrew from the contract within 14 days from the order delivery date. Thus artledistic.com maintains the minimum term of 14 days provided in art. 9 of GEO 34 of June 4, 2014 regarding consumer rights in contracts concluded with professionals, as well as for the modification and completion of some normative acts
7.8.2. artledistic.com does not cover delivery costs for returned products. The buyer will bear the direct cost of returning the products. The return is requested and processed through the My Account section on artledistic.com. The customer will use any fast courier company (but not the Romanian Post) according to art 13 paragraph 3 and art 14 of the Emergency Ordinance no. 34 of June 4, 2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts.
7.8.3. Before the expiration of the withdrawal period, the Client informs artledistic.com about his decision to withdraw from the contract. For this purpose, the Client can choose one of the following options:
a) to use the withdrawal form model available on the artledistic.com website in the Return section;
b) to make any other unequivocal statement in which he expresses his decision to withdraw from the contract.
7.8.4. The customer who has notified artledistic.com according to art 7.8.3, is responsible for ensuring that the products he referred to have been returned or handed over to artledistic.com or to a person authorized by artledistic.com to receive the products (usually express courier company indicated in the return form on artledistic.com), without unjustified delay and within no more than 14 days from the date on which he communicated to artledistic.com his decision to withdraw from the contract. The term is respected if the products are sent by the Customer before the expiry of the 14-day period properly packed for protection during transport.
7.8.5. The artledistic.com customer will not be able to return the purchased products and/or will not claim any other damages/compensations, in the following situations:
7.8.5.1. If the return request for any of the situations provided in art. 7.8.1 has the date of dispatch of the notification of return intention that exceeds the period of 14 days provided according to art 7.8.2, calculated from the working day following the date of the honored contract.
7.8.5.2. If a product is returned for one of the situations provided in art. 7.8.1, and the returned product is not in the same condition in which it was delivered (with the documents that accompanied it, with all components).
7.8.5.3. If the products were made according to the specifications presented by the Customer or clearly personalized.
7.8.5.4. If sealed products were ordered and delivered that cannot be returned for health protection or hygiene reasons and that were unsealed by the Customer (these products are: coconut bowls and candles).

7.8.5.5. If products were ordered and delivered which are, after delivery, according to their nature, inseparably mixed with other elements.
7.8.6. The Member/Client will be informed in the e-mail placing the order if it is returnable or not and if there are costs in case of return. Products that constitute a kit/set must be returned as a kit/set.
7.8.7. In the event of the Customer's withdrawal from the contract, artledistic.com reimburses him all the sums he received as payment from his side, including, as the case may be, delivery costs, without undue delay and, in any case, no later than 14 days from the date on which he is informed of the decision to withdraw from the contract.

8. FRAUD
8.1. artLEDistic does not ask its Customers or Users by any means of Communication (e-mail/telephone/SMS/ etc.) for information related to confidential data, bank accounts/cards or personal passwords.
8.2. Exception to art. 8.1 is only made to legal entity Customers, in the sense of obtaining by artLEDistic the account number, respectively the bank of the Customer, in whose name an Order will be invoiced.
8.3. The Customer assumes full responsibility for the disclosure of its confidential data to a third party.
8.4. artLEDistic disclaims any liability, in the event that a Customer would be/is harmed in any way by a third party claiming to be/representing the interests of artLEDistic.
8.5. The Customer shall inform artLEDistic of any such attempts using the contact details.
8.6. artLEDistic does not promote SPAM. Any Customer who has explicitly provided his/her email address on the site may opt to have it deleted.
8.7. Communications made by artLEDistic by electronic means of Remote Communication (i.e. e-mail) contain the sender's complete and correct identification data or links to them at the time of transmission of the content.
8.8. The following purposes achieved or not achieved will be considered as an attempt to defraud the site/content and/or artLEDistic and criminal investigation will be initiated against the person(s) who attempted to or achieved such purpose(s):
8.8.1. to access another Customer's data of any kind by using an account or by any other method.
8.8.2. alter or otherwise modify the content of the Site or Content sent by any method by artLEDistic to the Customer
8.8.3. affect the performance of the server/servers on which the Site runs
8.8.4. access or disclose to any third party who does not have the necessary legal authority, Content sent by any means by artLEDistic to the Customer when the Customer is not the legitimate recipient of the Content.

9. LIMITATION OF LIABILITY
9.1. artLEDistic cannot be held liable to any natural or legal person who uses or relies on the content.
9.2. artLEDistic cannot be held liable for any kind of damage (direct, indirect, accidental or otherwise /etc) resulting from the use or inability to use the content information presented or not presented on the website or for any kind of errors or omissions in the presentation of the content that may lead to any kind of loss.
9.3. If a Customer believes that any Content sent by any means by artLEDistic infringes copyright or any other rights, it may contact artLEDistic for details as per the contact details so that artLEDistic can make an informed decision.
9.4. artLEDistic does not grant the Customer access to the Site or the Service and does not grant the Customer the right to download or modify in part and/or in whole the Content, to reproduce in part or in whole the Content, to copy, or to exploit any Content in any other way, or to transfer to any third party any Content to which it has and/or has obtained access under a User Agreement, without the prior written consent of artLEDistic.
9.5. artLEDistic is not responsible for the content, quality or nature of other sites reached through links from the content, regardless of the nature of such links. For those sites, the responsibility is borne entirely by their owners.
9.6. artLEDistic is exonerated from any fault in case of use of the sites and/or of the content transmitted to the Customer by any means (electronic, telephone, etc.), through the sites, by e-mail or by an employee of artLEDistic, when this use of the content can or does cause damage of any nature on the part of the Customer and/or any third party involved in this transfer of Content.
9.7. artLEDistic does not give any direct or indirect warranty that:
- the service will be suitable for the Customer's requirements
- the service will be uninterrupted, reliable or error-free of any kind
- the products obtained free of charge or against payment through the service will meet the customer's requirements or expectations
9.8. The operators, administrators and/or owners of the site are in no way responsible for the relationships or their consequences resulting from, but not limited to, purchases, special offers, promotions, promotions, or any other type of relationship / link / transaction / collaboration / etc. that may arise between the customer and any of those who promote themselves directly or indirectly through the site.

10. FORCE MAJEURE AND FORTUITOUS EVENT
10.1. Unless expressly provided otherwise, neither party to a contract concluded under Article 7.4.8. which is still in progress shall be liable for failure to perform on time and/or properly, in whole or in part, any of its obligations under the contract if the failure to perform such obligation was caused by an event of force majeure.
10.2. The party or the legal representative of the party invoking the aforementioned event is obliged to inform the other party immediately and in full of its occurrence and to take any measures at its disposal to limit the consequences of such event.
10.3. The party or the legal representative of the party who invokes the above-mentioned event shall be released from this obligation only if the event prevents him from carrying it out.
10.4. If within 15 days from the date of occurrence of the event, the said event does not cease, each party shall be entitled to notify the other party of the termination of this contract without either party being entitled to claim any further damages.
10.5. The party claiming force majeure must prove the impossibility of performance within 30 days from the date of the event but within the limits of Article 10.3.

11. LITIGATION
11.1. By using/viewing/viewing/etc. the Sites and/or any content sent by artLEDistic to the Member/Customer by accessing and/or sending by any means (electronic, telephone, etc.), the Member/Customer agrees at least to these "Terms and Conditions".
11.2. Any dispute with reference to these Terms and Conditions that may arise between the Member/Customer and artLEDistic shall be settled amicably.
11.3. artLEDistic shall not be liable for any loss, costs, suits, claims, expenses or other liabilities, if they are directly caused by the breach of the Terms and Conditions.
11.4. Any dispute of any kind (excluding art. 11.2) that may arise between the Member and artLEDistic or its partners shall be settled amicably. If this is not possible, the conflict will be solved in court, according to the Romanian laws in force.
11.5. If any of the above clauses is found to be void or invalid, regardless of the cause, this clause shall not affect the validity of the other clauses.
11.6. This document has been drawn up and shall be interpreted in accordance with Romanian law.

12. FINAL PROVISIONS
12.1. artLEDistic reserves the right to make any changes to these provisions, as well as any changes to the site/its structure/service, including changes that may affect the site and/or any content without prior notice to the Customer.
12.2. artLEDistic shall not be held responsible for any errors occurring on the site due to any cause, including due to changes, settings, etc., which are not made by the site administrator.
12.3. artLEDistic reserves the right to place advertising banners of any kind and/or links on any page of the site, in compliance with the legislation in force.
